Please read these terms carefully before using MySmartBus.

These Terms of Service ("Terms") govern your access to and use of MySmartBus services, including our mobile applications and website, operated by MySmartBus Technology Pvt. Ltd. ("Company", "we", "us", or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you disagree, you may not use our Services.

1. Acceptance of Terms

By creating an account, downloading the app, or using any part of the MySmartBus platform, you confirm that you are at least 18 years of age (or have parental consent), have read and understood these Terms, and agree to be legally bound by them.

2. Description of Service

MySmartBus provides a school bus tracking platform that includes:

  • Real-time GPS tracking of school buses via mobile applications
  • Push notifications and SMS alerts for parents/guardians
  • A driver application for trip management and student attendance
  • A school administration web dashboard for fleet and route management

3. User Accounts & Responsibilities

3.1 Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your password and all activities under your account.

3.2 Prohibited Activities

  • Using the service for any unlawful purpose
  • Attempting to access accounts or data of other users without authorisation
  • Interfering with or disrupting the service or its servers
  • Sharing false, misleading, or harmful information
  • Reverse engineering, decompiling, or disassembling the application
  • Using the service to harass, threaten, or intimidate any person

4. Privacy

Your use of MySmartBus is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of information as described in the Privacy Policy.

5. Location Data

The Service requires access to GPS location data from the driver's device. By using the driver app, you grant MySmartBus permission to collect and transmit location data during active school bus trips. This data is used solely for the purpose of providing real-time bus tracking to parents and school administrators.

6. Subscription & Payment

School subscriptions are billed on a monthly or annual basis as agreed during onboarding. All fees are non-refundable unless otherwise stated in your subscription agreement. We reserve the right to suspend access for non-payment after 7 days' notice.

7. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind. While we strive for 99.9% uptime, we do not guarantee that the service will be uninterrupted, error-free, or completely accurate at all times. GPS accuracy may vary depending on device hardware and environmental conditions.

MySmartBus is a supplementary safety tool and should not be relied upon as the sole means of ensuring child safety.

8. Limitation of Liability

To the maximum extent permitted by applicable law, MySmartBus Technology Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability in any circumstance shall not exceed the subscription fees paid by you in the three months preceding the claim.

9. Intellectual Property

All content, trademarks, logos, and software associated with MySmartBus are the property of MySmartBus Technology Pvt. Ltd. and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in activities that harm the platform or other users. You may terminate your account at any time by contacting us at support@mysmartbus.in.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Navsari, Gujarat, India. We encourage resolution of disputes through mutual discussion before formal legal proceedings.

12. Changes to Terms

We may update these Terms periodically. Significant changes will be notified via email or in-app notification. Continued use of the Services after the effective date of changes constitutes acceptance of the updated Terms.
